For many years, Tesla Whistleblower, who fought with Elon Musk and his company for many years, won the latest legal battle.
Cristina Balan Engineers lost their jobs after raising safety issues on design defects that could affect car braking in 2014.
Her defamation claim for the company seemed to lack roads when the judge confirmed the decision to dismiss her case, but California’s appeal panel He canceled her favorite decision.
She told the BBC News that she wants to face Elon Musk and Tesla in an open court.
Tesla did not respond to the request.
Balan said he could actually start a new procedure, believing that the incident would actually return to Square One.
“We want to start a new lawsuit and have an opportunity to take Elon Musk in front of the jury and judge.”
The engineer was once very prominent in Tesla, and the initials were engraved on the battery inside the Model S vehicle.
Last year, in an interview with BBC News She said she decided to prove innocence for her son.
She also said she was relaxed in the 3B -level breast cancer, and her biggest concern is that she will not see the last day in court.

Balan insisted that the carpet was cured under some pedals of the Tesla model, causing a safety risk.
She said managers rejected her concerns, became hostile and lost their jobs.
Then she won the wrong dismissal case. But this turned out to be the beginning of a long journey through court.
Balan has been publicly accused of Tesla for his use of resources in “Secret Projects.”
She continued to refuse to accuse and decided to bring defamation to the company in 2019.
She told the BBC News last year.
“I hope Elon Musk has a dignity to apologize.”

The court then decided that Mr. Balan’s incident should work in Tesla and be subject to mediation under the contract.
The arbitrator was found in favor of the company and Musk and dismissed her claims due to California’s restrictions.
Tesla brought the case to the California District Court to confirm the decision.
But Balan appealed for this decision, and the judges of the US Court appealed for the ninth tour of her favor. In fact, the California court decided that there was no jurisdiction to make a ruling.
They ordered to cancel the arbitration award, and the District Court ordered them to dismiss action due to lack of jurisdiction.
What can happen next time?
The BBC says that the majority of legal experts believe that there is a way before the case is concluded.
“Tesla is one of the many companies that have aggressive strategies in order to retaliate for employees who have strengthened the opaque arbitration process and criticize corporate practices.”
And Balan’s lawyer, Bill Moran, agreed that the legal process was not over.
But he said the incident was “resurrected” by the latest ruling.
“We are convinced that we can listen her as a trial in a new arbitration or court and listen to her events a few years later.”
“She fought with cancer in this case.
